This Privacy Policy describes how FLAM Records (“we”, “us”, “our”) processes personal information when you use our website at https://flamtunes.live (the “Site”) and related online services we operate in connection with the Site.
1. Who we are
FLAM Records operates this Site as a collaborative space for AI music creators, with structured releases and media surfaces as described on the Site. For purposes of POPIA, we act as the responsible party in respect of personal information we determine the purpose and means of processing.

2. Scope
This Policy applies to personal information collected through the Site, including when you browse pages, use our contact channels, or interact with embedded third-party media (for example Spotify and YouTube players). It does not govern third-party websites or apps that we link to; those services have their own privacy notices.
3. What personal information we may collect
Depending on how you use the Site, we may process:
- Contact and enquiry data — if you email us, message us on WhatsApp, or use a contact form on the Site, we may receive your name, email address, phone number, and the content of your message.
- Technical and usage data — such as IP address, browser type, device type, general location (e.g. region/country derived from IP), pages viewed, and timestamps. This may be collected by our hosting or infrastructure providers (for example when content is delivered over the internet).
- Cookies and similar technologies — see our Cookie Notice for details on essential cookies and third-party embeds.
We do not intend to collect special personal information (as defined in POPIA) unless you voluntarily include it in a message to us; please avoid sending health or other sensitive information unless strictly necessary.
4. How we use personal information (purpose)
We use personal information to:
- operate, secure, and improve the Site;
- respond to enquiries, bookings, collaborations, press requests, or support messages;
- comply with law and protect our legitimate interests (including fraud prevention and enforcing our terms); and
- where applicable and permitted, communicate with you about FLAM Tunes releases, events, or updates (only if you have agreed or if the law allows direct marketing with an opt-out).
5. Lawful basis under POPIA
We process personal information only where permitted by POPIA, which may include: your consent (where we ask for it); processing that is necessary to perform a contract or take steps at your request; processing that pursues legitimate interests of FLAM Records or a third party (balanced against your rights); and processing required to comply with law or protect a legitimate interest such as security.
6. Third-party services and embeds
The Site includes features that rely on third parties:
- Spotify — embedded players and links may connect to Spotify’s services. Spotify may collect information according to its own policies when you use their player or leave our Site.
- YouTube (Google) — embedded video players may load content from YouTube. Google may use cookies and process data as described in Google’s privacy policies.
- Hosting and infrastructure — the Site may be hosted on platforms (for example Vercel) and use content delivery networks. Those providers process technical data necessary to deliver the Site.
Where we use a server-side feature to fetch public metadata (for example to display titles for Spotify links), we only request information that Spotify exposes for that purpose and handle it in line with this Policy.
7. Cross-border transfer
Some of our service providers may process data in countries outside South Africa (including the United States and the European Union). Where personal information is transferred across borders, we take steps that are appropriate in the circumstances, which may include ensuring the recipient is subject to laws, corporate rules, or agreements that provide an adequate level of protection as contemplated by POPIA, or obtaining your consent where required.
8. Retention
We retain personal information only for as long as needed for the purposes described in this Policy, unless a longer period is required or permitted by law. Technical logs may be retained for shorter periods for security and troubleshooting. Enquiry records may be kept for the period needed to respond and manage ongoing relationships, unless you ask us to delete them subject to legal obligations.
9. Security
We implement reasonable technical and organisational measures to protect personal information against unauthorised access, loss, or misuse. No method of transmission over the internet is completely secure; we encourage you to use secure channels and avoid sharing sensitive information unnecessarily.
10. Your rights (data subject rights)
Under POPIA, you may have the right to request access to personal information we hold about you, ask for correction or deletion where appropriate, object to certain processing, and lodge a complaint with the Information Regulator. You may also withdraw consent where processing is based on consent, without affecting the lawfulness of processing before withdrawal.
To exercise these rights, contact us at hello@flamtunes.com. We may need to verify your identity before responding.

11. Children
The Site is not directed at children under 18 in a way that collects personal information knowingly without parental consent. If you believe we have collected information from a child, please contact us and we will take appropriate steps.
12. Direct marketing
If we send direct marketing by electronic communication, we will do so in line with South African law (including POPIA and related provisions), provide identification and opt-out mechanisms, and honour your preferences.
13. Changes to this Policy
We may update this Privacy Policy from time to time. The “Last updated” date at the top will change, and for material changes we may provide a notice on the Site. Continued use of the Site after changes means you acknowledge the updated Policy.
